01 Acceptance and changes
Welcome to Rent Month to Month ("RentMTM", "we", "us"), operated by [Legal Entity Name]. By creating an account, browsing listings, booking a rental, placing an order or running an advertisement, you agree to these Terms of Use, to our Privacy Policy, and to the policies referenced in them, which are incorporated by reference.
If you do not agree, do not use the platform. We may change these Terms. We will post the new version with a new effective date and, for material changes, give at least thirty days' notice by email or in the account area. Changes apply prospectively; continuing to use the platform after they take effect means you accept them.
02 Eligibility and accounts
- You must be at least eighteen years old and able to form a binding contract.
- Your registration information must be accurate, current and complete.
- You are responsible for your credentials and for activity under your account.
- You may hold one personal account; business accounts require verification.
- You may not use the platform if you are subject to United States sanctions or are located in a comprehensively sanctioned jurisdiction.
03 Our role as a venue
RentMTM provides a venue, a booking and checkout system and a payment flow. Owners, sellers, advertisers and professionals are independent third parties. We are not a landlord, lessor, real estate broker, car rental company, carrier, contractor or insurer, and we are not a party to the contract you make with them.
Listings, reviews and messages are provided by users. Under 47 United States Code section 230 we are not the publisher or speaker of that content, and our moderation of some content does not make us responsible for all of it.
04 Rentals and listings
Rentals run on a month-to-month basis and are governed by the Rental Policy, the Renter Agreement and the Owner contract, together with the landlord-tenant, vehicle and vessel law of the place where the item is located.
If you list
- You must have the legal right to rent the item, and it must be safe, registered, insured and lawful.
- Your description, photographs, price and fees must be accurate, and mandatory fees must be disclosed before payment.
- You must comply with the Fair Housing Act and with all fair housing and non-discrimination obligations.
- You are responsible for local registration, licensing and lodging tax where they apply.
If you rent
- You must hold any license or certificate the item requires, and meet minimum age rules.
- You must use the item with care, within stated limits, and return it in the condition received.
- You must report damage and habitability issues promptly through the platform.
- Ending a month-to-month tenancy requires the written notice period your state prescribes.
05 Marketplace purchases
Goods are sold by third-party sellers under the Seller Agreement and the Buyer Agreement. Sellers ship within the stated time or within thirty days, as the Federal Trade Commission's order rule requires. Where we act as a marketplace facilitator we calculate, collect and remit sales tax. High-volume sellers are verified and their identity is disclosed as the INFORM Consumers Act requires.
06 Payments, fees and renewals
- You authorize us and our processor to charge your payment method for the amounts shown before you confirm, including rent, deposits, fees and tax.
- Service fees are disclosed before payment. Fee changes take effect on thirty days' notice.
- Month-to-month rentals and any subscription recur until cancelled. Before you pay we disclose the amount, the frequency and how to cancel, and we obtain your separate consent, as the Restore Online Shoppers' Confidence Act and state automatic renewal laws require.
- You can cancel a recurring charge yourself in the account area, in a way at least as easy as signing up.
- Refunds follow the Refund Policy. Nothing limits your right to dispute a charge with your card issuer or bank.
07 Your content and copyright
You keep ownership of what you post. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for display and distribute your content to operate and promote the platform, ending when you remove it, except for backups and records we must keep.
We comply with the Digital Millennium Copyright Act. Send notices of claimed infringement to our designated agent at [DMCA agent name, address, email]. We remove infringing material, accept counter-notices, and terminate repeat infringers. Details are in the Content and Moderation Policy.
08 Prohibited conduct
- Posting false, fraudulent, infringing or discriminatory content.
- Harassing, threatening or defaming another person.
- Taking transactions off the platform to avoid fees or safety protections.
- Writing, buying, incentivizing or suppressing reviews.
- Scraping, probing, overloading or interfering with the platform or its security.
- Using the platform for money laundering, sanctions evasion or any unlawful purpose.
09 Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant the condition, legality, safety or suitability of any item, property, vehicle, vessel or service offered by a user, or the accuracy of any listing. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTMTM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. Our aggregate liability arising out of or relating to the platform is limited to the greater of the fees you paid us in the twelve months before the claim or one hundred dollars.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or for a violation of a statute that forbids such limits. Some states do not allow the exclusion of incidental or consequential damages, so parts of this section may not apply to you.
11 Arbitration and class waiver
The full terms, including the informal resolution step, the fee allocation, the mass arbitration protocol and the opt-out address, are set out in our Dispute Resolution and Arbitration Agreement, which forms part of these Terms. The Federal Arbitration Act governs it. These Terms are otherwise governed by the law of the State of [state].
12 Termination and contact
You may close your account at any time in account settings, after completing open rentals and orders. We may suspend or terminate access for a violation of these Terms or for conduct that harms users or the platform, and we will tell you why unless the law prevents it. Sections that by their nature should survive, including content licenses for retained records, disclaimers, limitation of liability and arbitration, survive termination.
