How Rent Month to Month collects, uses, discloses and protects your personal information, and the privacy rights you have under United States federal and state law.

01 Who we are and what this covers

Rent Month to Month ("RentMTM", "we", "us") is operated by [Legal Entity Name], with a principal place of business at [postal address]. This Policy applies to the marketplace, the rental gateway, the storefront and advertiser landing pages, the account areas and the control panel.

It serves as our notice at collection and our full privacy policy under the California Consumer Privacy Act as amended by the California Privacy Rights Act, and under the comprehensive privacy statutes of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana and other states that have enacted them. Owners, sellers, advertisers and professionals who use the platform are separate businesses and have their own privacy practices.

02 Information we collect

In the last twelve months we have collected the following categories of personal information:

  • Identifiers. Name, email address, telephone number, postal and billing addresses, account identifier and network address.
  • Customer records. Payment method details held by our processor, bank account and routing numbers for payouts, and transaction history.
  • Protected classification characteristics. Date of birth, gender and nationality, where you provide them.
  • Commercial information. Listings, bookings, orders, favorites, budgets and service orders.
  • Internet activity. Pages viewed, searches, device and browser data, and interaction with advertisements.
  • Geolocation. Approximate location derived from your network address, and the addresses of rental items and service locations you enter.
  • Audio and visual information. Photographs of listings and items, profile photographs and identity selfies.
  • Professional information. Business name, employer identification number, licenses and certifications.
  • Inferences. Preferences and risk signals derived from the above.

We collect this information directly from you, automatically as you use the platform, and from service providers such as identity verification, payment and fraud prevention vendors.

03 Sensitive personal information

To verify identity, to release payouts and to meet legal obligations, we collect government identification documents, driver license number and class, passport number, Social Security number, financial account numbers and, where we compare an identity selfie to your identification document, a facial geometry scan.

We use sensitive personal information only to verify identity, to prevent fraud, to process payments and payouts, to comply with tax and anti-money-laundering obligations, and to provide the service you requested. We do not use or disclose it to infer characteristics about you, and we do not sell it. Biometric identifiers are collected only with your written release and are destroyed within three years of your last interaction, or sooner when the verification purpose is satisfied.

04 How we use it

  1. To create and administer your account and to authenticate you.
  2. To publish listings and to arrange rentals, orders and service engagements.
  3. To process payments, deposits, refunds and payouts.
  4. To verify identity and to satisfy tax, sanctions and anti-money-laundering obligations.
  5. To detect, investigate and prevent fraud, abuse and security incidents.
  6. To provide customer support and to resolve disputes.
  7. To measure and improve the platform and to develop new features.
  8. To send service messages, and marketing messages where you have opted in.
  9. To comply with law and to establish, exercise or defend legal claims.

05 Disclosure, sale and sharing

We disclose personal information for business purposes to:

  • The other party to your transaction, so that a rental, an order or a service can be completed.
  • Payment processors, identity verification vendors and fraud prevention vendors.
  • Cloud hosting, email, messaging and analytics providers acting as our service providers.
  • Professional advisers, and to an acquirer in a merger or asset sale, with notice.
  • Law enforcement and regulators in response to valid legal process.

We do not sell personal information for money. When advertising and analytics technologies are enabled, the disclosure of identifiers and internet activity to advertising partners for cross-context behavioral advertising may be a "sale" or "sharing" as those terms are defined by state law. You can turn that off at any time through Your Privacy Choices, and we honor the Global Privacy Control signal.

If you are a California resident, the Shine the Light law, Civil Code section 1798.83, lets you request a list of the personal information we disclosed to third parties for their own direct marketing in the prior calendar year. We do not make such disclosures.

06 Cookies and advertising choices

We use strictly necessary technologies to keep you signed in and the platform secure, and, with your consent, functional, analytics and advertising technologies. Manage them at any time from Your Privacy Choices in the footer. Details are in our Cookie and Tracking Technologies Policy.

07 Your privacy rights

Depending on the state in which you live, you may have the right to:

  • Know the categories and specific pieces of personal information we have collected, the sources, the purposes and the recipients.
  • Obtain a portable copy of the personal information you provided.
  • Correct inaccurate personal information.
  • Delete personal information, subject to legal exceptions.
  • Opt out of the sale or sharing of personal information and of targeted advertising.
  • Limit the use and disclosure of sensitive personal information.
  • Opt out of profiling that produces legal or similarly significant effects, and to appeal an automated decision.
  • Not be discriminated against or retaliated against for exercising these rights.

08 How to exercise your rights

Submit a request from the privacy area of your account, by emailing privacy@rentmtm.shop, or by calling [toll-free number]. We verify your identity before acting, using information already associated with your account. An authorized agent may submit a request with written permission that we can verify.

We acknowledge requests within ten business days and respond within forty-five calendar days, extendable once by another forty-five days with notice. If we deny a request in whole or in part, we explain why and you may appeal by replying to our response; we decide the appeal within forty-five days and tell you how to contact your state attorney general if you disagree.

09 Retention and deletion

We keep each category only as long as needed for the purpose it was collected for and for the periods set out in our Data Retention and Deletion Policy: account records for the life of the account and four years after; rental, order and payment records for seven years; identity documents and selfies for no more than three years; access logs for twelve months. After that, records are destroyed or irreversibly de-identified.

10 Security and breach notice

We apply administrative, technical and physical safeguards, including encryption in transit and at rest for sensitive data, role-based access control, audit logging and periodic testing. No system is perfectly secure, so please use a strong, unique password and enable multi-factor authentication where offered.

If a breach affects your personal information, we will notify you and the applicable state regulators in the manner and within the deadlines that the breach notification statute of your state requires, without unreasonable delay.

11 Children and minors

The platform is for adults. You must be at least eighteen to hold an account. We do not knowingly collect personal information from children under thirteen, as the Children's Online Privacy Protection Act addresses, and we do not sell or share the personal information of any consumer we know to be under sixteen. If you believe a minor has provided information to us, contact us and we will delete it.

12 Changes and contact

We review this Policy at least annually and update it when our practices change. The effective date appears at the top, and we give prominent notice of material changes.
